AGB (Verbraucherkunden)

Allgemeine Geschäftsbedingungen der Innovator Academie, Martina Swoboda, Moosstrasse 5, 90522 Oberasbach, gegenüber Verbrauchern (§ 13 BGB).

1 Geltungsbereich

(1) Diese Allgemeinen Geschäftsbedingungen, im Folgenden AGB genannt, gelten für alle in Textform geschlossenen Verträge zwischen Martina Swoboda und Ihnen als Kunden für Onlinekurse und Dienstleistungen.

(2) Maßgebend ist die jeweils bei Abschluss des Vertrags gültige Fassung der AGB.

(3) Abweichende Bedingungen des Kunden werden nicht akzeptiert. Dies gilt auch ohne ausdrücklichen Widerspruch der Innovator Academie.

2 Vertragsgegenstand

(1) Wir bieten unseren Kunden Online-Coaching, Schreibberatung und Lektorat an. Der Anspruch auf die Erreichung eines bestimmten persönlichen Erfolgs, einer Note oder Ähnlichem besteht für den Kunden nicht. Beim Lektorat ist das Ziel unserer Leistung eine Reduzierung aller vom Kunden verursachten Fehler im Ausgangstext sowie Vorschläge zur Verbesserung von Verständlichkeit und Stil aufzuzeigen.

(2) Der Kunde erkennt ausdrücklich an,  dass  eine  hohe, durch ihn verursachte, Fehlermenge  in seinem Ausgangstext  sowie  ein  durch  ihn  bewirkter  Zeitdruck beim lektorieren das Ziel beeinträchtigen kann. Nach Abschluss des Lektorats können somit immer noch Fehler im Text vorhanden sein.

(3) Die Buchung unserer Onlinekurse und Dienstleistungen erfolgt nur online.

(4) Der Kunde ist selbst dafür verantwortlich, dass er die für die Beratungsleistungen von Martina Swoboda erforderlichen technischen Voraussetzungen schafft und diese funktionstüchtig sind. Bei technisch nicht funktionierendem Equipment besteht der Vergütungsanspruch von Martina Swoboda weiterhin und unberührt.

3 Vertragsschluss

(1) Der Vertragsschluss zwischen Martina Swoboda und dem Kunden kann nur in Textform erfolgen. Dies kann auch über die Anbieter fyndery und elopage erfolgen.

(2) Ihre Buchung wird per E-Mail bestätigt.

(3) Die Vertragssprache ist deutsch.

4 Preise und Zahlungsbedingungen

(1) Alle Preise sind Bruttopreise inklusive der gesetzlichen Umsatzsteuer, sofern diese erhoben wird.

(2) Die Innovator Academie ist berechtigt, ein Drittunternehmen mit der Abwicklung der Bezahlung gegenüber dem Kunden zu beauftragen.

(3) Die Vergütung für Dienste oder Onlinekurse ist bei Vertragsabschluss, vor Erbringung der Leistung, in voller Höhe zu zahlen.

(4) Die Zahlung erfolgt bei der Buchung auf den Seiten fyndery oder elopage.

(5) Der Kunde erhält eine Rechnung über die gebuchten Leistungen.

5 Kündigung und Laufzeit

(1) Verträge haben die bei der Buchung vereinbarte Laufzeit. Die vorzeitige Kündigung während der Vertragslaufzeit ist ausgeschlossen.

(2) Kündigungen bedürfen der Schriftform.

(3) Das Recht zur außerordentlichen Kündigung bleibt unberührt.

6 Widerrufsrecht

Als Verbraucher steht ihnen nach § 13 BGB bei Fernabsatzverträgen ein Widerrufsrecht von 14 Tagen zu. Der Widerruf bedarf der Schriftform.

Children’s Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

Updating your personal information

We offer a ‘My details’ page (also known as Dashboard), where you can update your personal information at any time, and change your marketing preferences. You can get to this page from most pages on the site – simply click on the ‘My details’ link at the top of the screen when you are signed in.
